Litigation is the largest and one of the best-known practice areas at Phillips Nizer. Roughly half of our lawyers practice in litigation and litigation-related fields. Our clients include many of the world’s largest and most prestigious fashion houses and most prominent fashion designers, located both in the United States and in other jurisdictions, as well as many other companies in the fashion arena. We provide a full range of services to these companies, including corporate and business transactions of all kinds, tax planning, trademark and copyright registration and enforcement, counterfeiting and unfair competition. We have been particularly active in trademark and intellectual property licensing ventures, representing US-based companies in their domestic and international licensing activities and also foreign companies in the United States and elsewhere throughout the world, both as licensors and as licensees. We work with traditional single product manufacturing/wholesale licenses concerning the widest variety of product categories, a number of which have involved hundreds of millions of dollars of business. We counsel U.S. and international clients on information security, privacy, data protection and data breach notification issues. Our attorneys have written and lectured on cross-border discovery issues and the conflict between U.S. e-discovery rules on the one hand, and the EU data protection directive and national privacy laws of the EU states on the other. They are also experienced in the problems EU-member state businesses have as a result of the data protection laws of the EU and its member states in communicating certain information to their U.S. partners, parent companies and subsidiaries (and vice versa).
