Managing Partner Marc Landis is interviewed by Commercial Observer: Leases are Getting Shorter and Rents are Dropping with U.S. Office Market in Turmoil (July 17, 2020)07/17/2020
The coronavirus pandemic has brought the United States office market to a near halt, and the path to recovery is as uncertain as ever, experts say. “I believe the second theory has gone a lot further than the first theory at the moment,” he said. “That is a function not only of employer considerations — feeling they need less space and would like to spend less when times are tough — but also the employees who prefer operating remotely more often than not. There are people who have cabin fever or would like to be able to function without kids underfoot, but a lot of people are functioning well.”

Phillips Nizer White Collar Practice Chair Ilene Jaroslaw is quoted in Law360 article: Loughlin's 'Sweetheart' Deal May Spark 'Varsity Blues' Pleas05/22/2020
Ilene Jaroslaw, a former federal prosecutor and the chair of Phillips Nizer LLP's white collar and investigations practice group, said the agreed-upon sentences for Loughlin and Giannulli, which are far lower than some of the terms suggested by the government in other "Varsity Blues" cases, could encourage parents with perhaps stronger cases to sit down with the government and see how much better they could do.

Ilene Jaroslaw is quoted in New Jersey Law Journal: Justices Unanimously Overturn Bridgegate Convictions, Ruling Against Feds05/12/2020
The ruling means fewer tools are available to federal prosecutors to rein in corruption and abuse of power by public officials, said Ilene Jaroslaw, head of the white-collar group at Phillips Nizer and a former prosecutor in the Eastern District of New York.
“The court held today that public officials cannot be guilty of federal wire fraud or government-programs fraud unless the corrupt state actor’s objective is to obtain money or property. Merely implementing bad policy out of venality or other bad motives does not violate these federal criminal statutes,” Jaroslaw said.

"These Supreme Court cases are very good in telling us where our current statutory system is lacking," Jaroslaw said. "Maybe if we want those norms and ethics to prevail, we need a new set of statutes." -

"When you have an up market, which we had for some time, you can squeeze by," Behr said of overleveraged companies. "But the moment things go bad, it's the companies that have poor cash positions that fall. And something bad happened in the market."

“If students are no longer taking NY practice, then we really have lost something of value,” said Millett, who added that knowledge of New York law is necessary for the state courts to remain a pre-eminent destination for settling international commercial transactions.
Millett, a partner at Phillips Nizer, added that the changing economics of the profession is also having an impact on the lack of preparation judges are encountering. With more students going to law school, the competition has intensified and some can’t find jobs in the kinds of firms that train beginning lawyers before sending them to court. -

“With anything involving software, anything involving anything online, it’s always an IT security risk,” said Phillips Nizer partner and former New York state Department of Financial Services deputy superintendent Patrick Burke.” So while the blockchain itself is generally pretty impregnably accept for the ‘51% attacks’, the software written around the blockchain is as susceptible as any other software.”
“At DFS, we would look at [a blockchain's] vulnerability to 51% attacks,” Burke said. ”You have to look at the number of miners it would take, what is the criteria for controlling [it], is it proof of work, proof of stake [and] how small of a group can pull off a 51% attack.” -
